These Terms and Conditions (Terms) govern all purchases of reports from Duma Gqubule (Seller, we, us), trading as The Transformation Lens (Pty) Ltd via www.dumagqubule.com. By placing an order, you (Customer, you) agree to these Terms. Please read them carefully before making any purchase.

1. The Seller

Duma Gqubule is an individual academic researcher trading as The Transformation Lens, based in Gauteng, South Africa. Email: colene@thetransformationlens.africa

2. Products

We sell research and academic reports in both digital (PDF or similar) and physical (printed, courier-delivered) format. All reports are original works compiled and authored by the Seller.

Descriptions of reports, including subject matter, page count, and format, are provided on the Website. It is your responsibility to confirm that a report meets your needs before purchasing, as all sales are final (see clause 7).

3. Ordering and Payment

All orders are placed via the Website. Prices are listed in South African Rand (ZAR) and include VAT where applicable. We reserve the right to change prices at any time without notice; however, the price at the time of your order will apply to that order.

Payment is due in full at the time of order. We accept payment via the methods listed on the Website. The Seller does not store your payment card details.

4. Digital Delivery

For digital reports, delivery will be completed within [24–48 hours] of confirmed payment to the email address provided. You are responsible for providing a correct email address. The Seller is not liable for non-delivery caused by an incorrect email address or spam filters.

You may download your digital report up to [3] times within [30] days of purchase. After this period, access may no longer be available.

5. Physical Delivery

For physical reports, orders will be dispatched within [3–5] business days of confirmed payment to the address provided. Delivery times thereafter depend on the courier or postal service used. The Seller will endeavour to use reliable delivery methods but is not liable for delays caused by third-party courier or postal services.

Risk in the physical report passes to you upon dispatch. If a physical report is lost in transit, please contact us within 14 days of the estimated delivery date.

6. Intellectual Property

All reports are protected by copyright under the Copyright Act 98 of 1978. Upon purchase, you receive a personal, non-exclusive, non-transferable licence to use the report for your own research, reference, or professional purposes.
You may not:
• Reproduce, redistribute, resell, or sublicense the report in whole or in part;
• Share the report with third parties without the Seller’s written consent;
• Use the report content to create derivative commercial works.

7. Returns and Refunds

Due to the nature of intellectual property, the following refund policy applies:

7.1 Digital Reports

All digital report sales are final. No refunds will be issued once a digital report has been delivered, except where the file is materially defective (i.e. corrupted or unreadable). In that case, we will re-deliver a working copy or issue a full refund at our discretion.

7.2 Physical Reports

If a physical report arrives damaged or materially defective, you must notify us within 7 days of receipt with supporting photographs. We will arrange a replacement or refund at our discretion. No returns are accepted for change of mind.

8. Consumer Protection Act

To the extent that the Consumer Protection Act 68 of 2008 (CPA) applies to these transactions, nothing in these Terms limits any right you may have under the CPA.

9. Limitation of Liability

The Seller’s total liability to you for any claim arising out of or in connection with these Terms shall not exceed the amount paid by you for the relevant report. The Seller shall not be liable for any indirect, consequential, or special damages.

10. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute shall be referred to the South African courts with jurisdiction. Before commencing legal proceedings, the parties agree to attempt to resolve the dispute in good faith.

11. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on the Website. Your continued use of the Website or placing a new order constitutes acceptance of the updated Terms.
